1. Agreement to Terms
By creating an account, subscribing to a plan, or using any feature of X AI Automation & Design, you confirm that:
- You are at least 18 years of age or have the legal authority to enter into contracts in your jurisdiction.
- You have the authority to bind the business entity on whose behalf you are acting.
- You have read, understood, and agree to these Terms and our Privacy Policy.
- You will comply with all applicable laws and regulations.
These Terms constitute a legally binding agreement between you and X AI Automation & Design.
2. Services
X AI Automation & Design provides AI-powered digital marketing automation services including, but not limited to:
- AI SEO Content — Automated research, writing, and publishing of keyword-optimized articles to your website.
- GEO Visibility — Optimization of your content and digital presence to appear in AI engine results (ChatGPT, Perplexity, Google AI, Microsoft Copilot, Gemini).
- Lead Generation — Embeddable widget that captures visitor contact information and delivers instant notifications.
- Google My Business Automation — Automated creation and publishing of posts to your Google Business Profile.
We reserve the right to modify, suspend, or discontinue any service or feature at any time with reasonable notice. Service features and limits are defined by your chosen subscription plan.
We do not guarantee specific rankings, citation counts, lead volumes, or business outcomes. Results vary based on industry, competition, location, website quality, and other factors outside our control.
3. Billing & Subscriptions
3.1 Subscription Plans
Our services are offered on a recurring subscription basis. Available plans and their features are described on our Pricing page. Prices are listed in Canadian dollars (CAD) unless otherwise stated and are subject to applicable taxes.
3.2 Billing Cycle
Subscriptions are billed monthly or annually in advance, depending on the plan you select. Your billing cycle begins on the date you subscribe and renews automatically on the same date each month or year.
3.3 Payment Methods
We accept major credit cards (Visa, Mastercard, American Express) and other payment methods as displayed at checkout. By providing payment information, you authorize us to charge the applicable fees to your payment method.
3.4 Failed Payments
If a payment fails, we will attempt to retry the charge up to three times over seven days. If payment remains unsuccessful, your subscription may be suspended until the outstanding balance is resolved. You are responsible for keeping your payment information current.
3.5 Price Changes
We reserve the right to change subscription prices with at least 30 days' written notice sent to your registered email address. Continued use of the service after a price change takes effect constitutes acceptance of the new price.
3.6 Taxes
Prices are exclusive of applicable taxes. Clients in Canada may be subject to GST/HST based on their province. You are responsible for all applicable taxes in your jurisdiction.
4. Cancellation & Refunds
4.1 Free Trial
We offer a 14-day free trial for new subscribers. No credit card is required to begin the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the service. Trial accounts that are not converted will be automatically deactivated.
4.2 Cancellation by Client
You may cancel your subscription at any time through your account dashboard or by contacting us at info@xaiautomation.ca. Cancellation takes effect at the end of your current billing period. You will retain access to the service until that date.
4.3 Refund Policy
All subscription fees are non-refundable except as required by applicable law. We do not offer pro-rated refunds for unused portions of a billing period. In exceptional circumstances (e.g., documented service outage), refunds or credits may be considered at our sole discretion.
4.4 Cancellation by Us
We reserve the right to suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or misuse the service. In such cases, no refund will be issued.
5. Acceptable Use
You agree not to use our services to:
- Publish content that is defamatory, obscene, hateful, or unlawful.
- Violate any intellectual property rights of third parties.
- Engage in spam, phishing, or deceptive marketing practices.
- Attempt to reverse-engineer, scrape, or copy any part of our platform.
- Access or tamper with accounts or data belonging to other users.
- Use the platform to compete directly with X AI Automation & Design, including reselling our services without written permission.
- Violate any applicable local, provincial, national, or international law or regulation.
We reserve the right to remove any content or suspend any account that violates these guidelines without prior notice.
6. Intellectual Property
6.1 Our Platform
The X AI Automation & Design platform, including all software, designs, trademarks, and documentation, is the exclusive property of X AI Automation & Design and is protected by Canadian and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
6.2 Your Content
AI-generated content published to your website or Google Business Profile on your behalf becomes your property upon delivery. You grant us a limited, non-exclusive licence to use, reproduce, and distribute your existing business information (name, logo, services, location) solely for the purpose of providing the services.
6.3 Feedback
Any feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation to you.
7. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by the following principles, consistent with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation:
- Data collected: We collect information you provide during signup (name, email, billing details, business information) and usage data generated through your use of the service.
- How we use it: To provide and improve our services, send transactional and marketing communications (with consent), process payments, and comply with legal obligations.
- Third parties: We do not sell your personal data. We share data only with trusted service providers (e.g., payment processors, cloud infrastructure) as necessary to deliver our services, and require them to maintain appropriate confidentiality.
- Retention: We retain your data for as long as your account is active and as required by law. You may request deletion of your data at any time by contacting us.
- Security: We implement industry-standard security measures including encryption, access controls, and regular security reviews. No method of transmission or storage is 100% secure.
- Cookies: Our website uses cookies for analytics, functionality, and marketing. You may control cookie settings through your browser.

8. Limitation of Liability
To the maximum extent permitted by applicable law, X AI Automation & Design and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the service.
Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total fees paid by you to us in the three (3) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.
9. Disclaimer of Warranties
The services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The service will be uninterrupted, error-free, or free of viruses or other harmful components.
- Results obtained through the service will be accurate, reliable, or meet your specific requirements.
- Any defects will be corrected within a particular timeframe.
- AI-generated content will be free of factual errors, and we recommend reviewing all published content.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the use of our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration administered by the ADR Institute of Ontario, or to the courts of Ontario, as elected by us.
You agree to submit to the personal jurisdiction of the courts located in Ontario, Canada for any disputes not subject to arbitration.
11. Changes to Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you by email at least 14 days before the changes take effect and update the “Last Updated” date at the top of this page.
Your continued use of the service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must cancel your subscription before the effective date.
